Terms and Conditions of Service

    This document sets out the Terms and Conditions ("Terms") on which PCG Talent Market ("Talent Market") provides customers with access to certain recruitment management services through the www.talentmarket.co.za website ("Website").

    Please read these terms very carefully before using the website and the Talent Market services. You acknowledge and agree that by clicking on "I accept" (in these terms, the "Customer"), you agree that as user/jobseeker/company or organisation you will be bound by these terms as a customer. You warrant and represent that you have full capacity and authority to enter this agreement on behalf of the yourself (user/jobseeker), customer company or organisation.

    If you do not accept these terms, you will not be able to use the website and the services. You are advised to print and retain a copy of these terms for future reference. By using this system/website users/ job seekers/companies agree to be bound by the terms of conditions and services set out below.

  1. Amendment of these terms
    1. The user/job seeker/company will be fully responsible for any activity carried out on the site through their account.
    2. The user/job seeker/company is responsible for maintaining the integrity and confidentiality of their login details, including username, email address and password.
    3. Users /job seekers/companies must notify PCG Talent Market immediately in the case of any unauthorised use of their username and password, or any suspected breach of security on their account.
    4. PCG Talent Market will make all reasonable endeavours to maintain the system, but reserve the right to modify or withdraw, temporarily or permanently, the system or any part thereof, with or without notice to users/job seekers/companies, without incurring any liability to you or any third party.
    5. Users/job seekers/companies will not be eligible for any compensation if they are unable to use any part of the system due to a temporary failure or suspension caused by circumstances beyond PCG Talent Market’s control.
    6. PCG Talent Market reserves the right to monitor and investigate any reported violation of these terms of conditions and service, and to take any action that PCG Talent Market deems appropriate, including, but not limited to, issuing a warning, enforcing suspension or account termination, or imposing conditional access on the users/ job seeker’s/company’s account.
    7. By using, accessing, or viewing this website job seekers/companies agree to these terms and conditions, including any document that may be incorporated by reference thereto.
    8. Users/Job seekers/companies may only use this system and its content to for lawful purposes.
    9. The use of this system does not extend to its’ source code or to the source code of any software or computer program that forms part of the system.
    10. Users/Job seekers/companies are not allowed to republish any information obtained on this website or distribute it in any manner.
    11. Use of this website is strictly at your sole risk.
    12. PCG Talent Market may, in its sole discretion, at any time and for any reason and without prior written notice, suspend or terminate: the operation of this website or withdraw any of the content; or users/ job seeker’s/company’s right to use this website.
    13. PCG Talent Market reserves the right to make amendments to the content and information on this system/website, including, but not limited to, amendments to pricing and rates. Users/Job seekers/companies acknowledge that each time they use the website it is their duty to familiarise themselves with any amendments that may have been made since they last used the website.
    14. Automated transactions and searches are subject to these terms and conditions.
    15. The use of malicious search technology is prohibited.
    16. The use of search technology in an unlawful manner or for the collecting or harvesting of data for commercial gain is prohibited.
  2. Use of the PCG Talent Market site
    1. All content on this site, including design, graphics, trademarks, data, software, and textual content, remain the property of PCG Talent Market, and any copyright infringement will be dealt with under the appropriate law.
    2. Unauthorised copying or scraping of any content contained on this site is expressly prohibited.
    3. No user/job seeker/company may copy, reproduce, distribute, transmit, repost, publish, or otherwise transfer or commercially exploit any information, software, code, design, or other content accessed through this website.
    4. Using any computer programme or routine to extract or attempt to extract any part of the content of the site/ system, including user-generated content, is strictly forbidden. In addition, no job seeker/company may decompile, reverse engineer, or disassemble any part of the site/ system.
  3. PCG Talent Market's intellectual property
    1. All content on this site, including design, graphics, trademarks, data, software, and textual content, remain the property of PCG Talent Market, and any copyright infringement will be dealt with under the appropriate law.
    2. Unauthorised copying or scraping of any content contained on this site is expressly prohibited.
    3. No user/job seeker/company may copy, reproduce, distribute, transmit, repost, publish, or otherwise transfer or commercially exploit any information, software, code, design, or other content accessed through this website.
    4. Using any computer programme or routine to extract or attempt to extract any part of the content of the site/ system, including user-generated content, is strictly forbidden. In addition, no job seeker/company may decompile, reverse engineer, or disassemble any part of the site/ system.
  4. Information provided by the User/Job seeker/Company
    1. The user/job seeker/company must provide us with true and accurate information upon registration, and amend their profile to reflect any changes to their situation or details, as soon as possible after such change occurs.
    2. Users/ job seekers/companies registered on this site may not post material that is offensive, derogatory, defamatory, obscene, or pornographic, nor material that contains profanity, vulgarity, hate speech, or threats of violence.
    3. Users/Job seekers/companies may not post copyright material without permission from the owner of that material.
    4. Users/Job seekers/companies may not post any material that contains any advertising, promotion or solicitation of goods or services for commercial purposes.
    5. PCG Talent Market reserves the right not to place any content or material provided by the user/ job seeker/company onto the site, and to remove such material for any reason, its sole discretion.
  5. Content provided by PCG Talent Market
    1. PCG Talent Market make no warranties or representations about the information provided on this site; and no information appearing on the site, or linked to from the site, should be seen to constitute professional advice in any way.
    2. PCG Talent Market does not guarantee that the information or content on the site will be error-free or will meet any criteria of performance or quality.
    3. PCG Talent Market reserves the right to remove, modify or alter any content on the site, at our sole discretion.
    4. PCG Talent Market furthermore reserve the right to restrict access to any services, information or applications contained on the site, at our sole discretion.

Although PCG Talent Market will take every reasonable step to ensure the confidentiality and security of your personal information, The Talent Market will in no way be held liable for any loss, harm, or damage suffered by users/ job seekers/companies because of transmitting sensitive information to The Talent Market.
  8. Risk and limitation of liability
    1. Users/Job Seekers/Companies make use of this website entirely at their own risk. The Talent Market will not be held liable for any costs, loss of profits, loss of data or consequential losses arising from or relating to the use of, or inability to use, this website.
    2. PCG Talent Market cannot guarantee that the site will always be fully operational and does not accept responsibility for any defects that may exist.
    3. While PCG Talent Market takes all reasonable precautions to ensure that any downloads that The Talent Market may make available on the site are virus-free, PCG Talent Market cannot warrant that such downloads will be virus-free, and will not be held liable for any losses you may incur because of downloading material from the site.
  9. Enforcement of these Terms & Conditions
    1. PCG Talent Market reserves the right to suspend your access to the site or any part thereof at any time, if PCG Talent Market deems job users/ job seekers/companies use of the site to be in any way abusive or in breach of these terms.
    2. These Terms of Conditions and Service will be governed by and construed in accordance with the laws of South Africa, and any dispute arising from them will fall under the jurisdiction of the South African courts.
